joe.jpgThe Giudice Family leaders, Teresa & Joe, found themselves in hot water back in 2014, after they were convicted on several counts of bankruptcy fraud.  Although the judge went easy on them, they both received prison sentences, allowing them to serve their sentences successively so that they wouldn’t be locked up at the same time, and their four daughters wouldn’t be without parents.   Teresa was released from prison in December 2015, giving her & Joe just a few weeks together as a family before he had to surrender & serve his 41 month sentence.  With early release, Joe could be out in 2019, but that’s just going to bring along more issues for the family.  Joe was born in Italy & never obtained a legal American citizenship, therefore Joe will most likely be deported after his release.  Joe is a multiple felon, so there will be lots of issues he’ll face if he attempts to stay in the U.S.  “Immigration consequences of criminal convictions depend on the particular criminal statutes implicated and are very case specific,” says attorney Sophia Solovyova. “Joe was convicted under a fraud statute,” Solovyova adds. “Its a deportable offense, for which waivers are available only in very limited circumstances.”  “If he applied for his green card while in the United States, he may be eligible. But if he came into the country with an immigrant visa, he would not be eligible.” “So, in short, he is deportable, but whether he has a case depends on his immigration history, personal circumstances and case law in third circuit.”
